Adaptive immunity is unique to the vertebrates, and the molecules involved (including immunoglobulins, T cell receptors and the major histocompatibility complex molecules) seem to have diversified very rapidly early in vertebrate history. Reconstruction of gene phylogenies has yielded insights into the evolutionary origin of a number of molecular systems, including the complement system and the major histocompatibility complex (MHC). These analyses have indicated that the C5 component of complement arose by gene duplication prior to the divergence of C3 and C4, (...) which suggests that the alternative complement pathway was the first to evolve. In the case of the MHC, phylogenetic analysis supports the hypothesis that MHC class II molecules evolved before class I molecules. The fact that the MHC‐linked proteasome components that specifically produce peptides for presentation by class I MHC appear to have originated before the separation of jawed and jawless vertebrates suggests that the MHC itself may have been present at this time. Immmune system gene families have evolved by gene duplication, interlocus recombination and (in some cases) positive Darwinian selection favoring diversity at the amino acid level. (shrink)

A fluent exposition and critical discussion of some recent thought on the existence of universals, the analysis of a priori statements, and the justification of ethical judgments and decisions, centered on the work of Russell, Moore, and the Positivists. The main criticisms draw heavily upon the author's earlier discussions of synonymity, a weakly articulated notion of explanatory utility, and a fruitful extension of Austin's analysis of performatory utterances. It sometimes happens that a philosopher will develop a view on some topic and then later come to reject it. J. L. Austin was perhaps unique in that he not only rejected a philosophical view of which he himself was the author, he patiently developed the view and then showed it to be ultimately unsatisfactory within the compass of the same work. And he did this not once but three times, in material intended for publication. I am thinking, of (...) course, of his notion of performative utterances: the view that there is a class of utterance, the members of which would on standard grammatical grounds be classed as statements, yet whose proper business is not to state anything but to perform some act. For example, to say ‘I promise to be there’ is to promise to be there, and not to state that one promises nor even to state that one will be there. (shrink)

It is Austin's view that there is no single answer to the question of what we are doing when we are perceiving. In some cases of perceiving, such as hearing, Austin thinks that it is legitimate to speak of ourselves as making inferences based on evidence and, therefore, as possibly making mistakes. In other cases of perceiving, however, such ways of speaking would be illegitimate. When we can be said to see something right in front of our noses, (...) it is meaningless to ask for our evidence, or to speak of ourselves as making inferences, or to think that we might be making mistakes. As Austin puts it, "But how absurd it is, really, to suggest that I am giving a verdict when I say what is going on under my nose!" To speak in such a manner would be, according to this view, to admit that "there is no such thing as being an eyewitness of what goes on in the 'material world'....". (shrink)

In this paper, I fill out the received view of logical positivism within professional philosophy against which Thomas Kuhn’s Structure appeared. To do this, I look at the methodological dimensions of ordinary language criticisms of logical positivist analysis from P.F. Strawson and J.L. Austin. While no one would confuse Strawson and Austin for philosophers of science, I look to their criticisms given the general porousness of sub-disciplinary boundaries in mid-20th century philosophy, the prominence of ordinary language philosophy in (...) the 1950s, and also because Kuhn was likely aware of their criticisms via Stanley Cavell. Their main charge is that the positivists base their ideal language analysis on an impoverished, yet overreaching account of meaning because they ignore ordinary linguistic practices. I then show how these methodological criticisms run parallel to points Kuhn makes against logical positivist approaches to the study of scientific knowledge. The parallels I draw emphasize methodological, rather than doctrinal dissatisfaction in mid-20th century philosophy with logical positivism’s perceived neglect of linguistic and scientific practices. An insight shared by these parallel criticisms is that logical positivists cannot declare linguistic and scientific practices irrelevant to their philosophical aims without an antecedent investigation of the practices under question. Styles eire attributed to works of art, bathing suits, neckties, and automobiles. But we also think of styles as ways of doing things. There are styles of teaching, styles of chess playing, styles of travel. The primary notion of style is the one which attaches to actions. When we speak of die style (...) of a poem or a portrait or em automobile we do so with reference to an action or actions associated with the object, usually the action or actions which appear to have been performed in die making of it. I will not argue now for this claim about style except to note that style attributions eure peculietrly alien to objects which are not products of human action. What is the style of a tulip, or an alpine meadow, or a pristine lake in the high Sierras? Are the Grand Canyon and Yosemite Valley in the same style or different ones? Sunsets in the tropics are very different from sunsets in the arctic, but is die difference a stylistic one? We might allow that in unusual cases natured objects can have styles. A chorus ofchirping birds might, just conceivably, chirp in the style of Haydn. But die notion of style here is obviously parasitic on diat which is applied to man-made eirtifacts. To think of an object as having a style is to mink of it as a product of human action.1 If actions are the primary possessors of style, to understand styles of fictionality we must look at die action of fiction-meddng emd its relation to works of fiction. I will concentrate on the very basic question ofwhat fiction is, what it is for something to be a work of fiction, and on attempts to answer this question in terms of die action offiction-making. It has been especially fashionable to utilize die notion ofspeech acts introduced by John Austin in tackling this problem. The fictional status of a work is, supposedly, to be accounted for by what illocutionary actions were or were not performed by the artist producing it, or by connections between what the artist did and certain illocutionary actions. My assessment of mis program will be mostly negative. Speech-act theory is remarkably unhelpful in explaining what fiction is. We have here something ofa "Have dieory, will travel" syndrome. There is a tendency for theorists, when 78 Kendall L. Walton79 faced with a new problem, to dust off an old theory which they know emd love, one devised with other questions in mind, shove it into die breach, and pray mat it will fit. In this case it does not fit, and the result is confusion radier dian illumination. Lest I step on toes other man the ones I am aiming at, let me empheisize that my present concern is not with the viability of speech-act theory as a dieory of language. Nor do I mean to deny that speech-act theory can be used fruitfully to illuminate important features of literary fictions. I am now addressing only die basic question of what fiction is, how works of fiction are to be differentiated from odier things. Whatever the other merits of speech-act theory, its applications to this question have been distinctly infelicitous. From our discussion of such applications em even stronger conclusion will emerge, the conclusion that the nature of fiction is not to be explicated in terms of acts of fiction-making at all. The notion of fiction is in diis respect contrary to that of style, and certain consequences about styles of fictionality follow. I Speech-act theory has been brought to bear on the problem of the nature of fiction in a number of rather different ways. I will look at four of them. The first is the idea that works of fiction are simply texts (or other representations ) which are not vehicles of illocutionary acts. It is true mat in writing fiction an author typically does not perform the illocutionary acts that a person who uses the setme words in a nonfictional setting is likely to be performing... (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

Several intrinsic/extrinsic distinctions amongst properties, current in the literature, are discussed and contrasted. The proponents of such distinctions tend to present them as competing, but it is suggested here that at least three of the relevant distinctions (including here that between non-relational and relational properties) arise out of separate perfectly legitimate intuitive considerations: though of course different proposed explications of the informal distinctions involved in any one case may well conflict. Special attention is paid to the question of whether a (...) single notion of property is capable of supporting the various distinctions. (shrink)

Even though tacit legal norms are deeply important to our past, present, and future, the very idea of unwritten law has been difficult to pin down, and problematic in a range of ways. Existing discussions of the phenomenon fall short of adequacy on one of several fronts: either they have focused on describing the normative features of one kind of unwritten law, or completely conflated the study of unwritten law with natural law, or else offered examinations of unwritten social rules, (...) focussing on (mere) custom, ethics, and/or etiquette. A particular defect is the fact that unwritten law has not been given a treatment by those working in the tradition of analytical jurisprudence. My thesis introduces a novel means of analyzing and explicating the elusive concept of unwritten legal rules, striving thereby to advance the state-of-the-art. In what follows I argue that unwritten laws are informally publicized rules held on the threat of formal sanction by an appropriate political authority. I argue that a law is informally disseminated just in case the appropriate governing theory of law, known to subjects, provides those subjects with a set of instructions about who to defer to concerning the contents of the law, absent dissemination in official venues. I propose that there are at least five potential kinds of unwritten law routinely recognized in legal studies: operations, implicit constitutions, justice norms, fiat rules, and secret laws. Through careful examination of extant theories of law (Aquinas, Hobbes, Foucault, Marx, Austin, Fuller, Hart, and Dworkin), I argue that there are identifiable structural features of the contents of these theories that make them more or less likely to endorse the legal validity of each kind of unwritten law. Throughout the course of the dissertation, I show how we are able to diagnose the ways in which these structural features of our theories of law differentially support the validity of—and shed important, additional light upon—each potential variety of unwritten law. We consider the modal logic of non-contingency in a general setting, without making special assumptions about the accessibility relation. The basic logic in this setting is axiomatized, and some of its extensions are discussed, with special attention to the expressive weakness of the language whose sole modal primitive is non-contingency , by comparison with the usual language based on necessity.

One of the central figures of philosophy of language- John Langshaw Austin, attributes principles of causation to the mere pragmatic language. Conversely, Kant tried to construct a “free human act” which is independent from any physical determination except its innate motivations via his well-known the phenomenal / noumenal distinction. That kind of Kantian metaphysical ground which addresses to the noumenal field, he obviously tries to establish this behavioral causation again by denying Austinian style pragmatic propositions or illocutionary acts. I (...) claimed that sort of duality between Austin and Kant, creates an epistemological problem with how propositions and actions relate. From a Kantian position, it (indetermination) is overlooked by Austin's propositional doctrine, without being grounded on any universal principle, but only with propositions that embraced by speech act theory. This paper considers the question: what becomes of the notion of a logic as a way of codifying valid arguments when the customary assumption is dropped that the premisses and conclusions of these arguments are statements from some single language? An elegant treatment of the notion of a logic, when this assumption is in force, is that provided by Dana Scott's theory of consequence relations; this treatment is appropriately generalized in the present paper to the case where we do not (...) make this assumption of linguistic homogeneity. Several applications of the resulting concept of a heterogeneous logic are suggested, but the main emphasis is on the formal development. One topic touched on is a certain contrast between the boolean and the intensional sentence-connectives in this more general setting. (shrink)

An account of the application conditions of a concept not meeting this requirement, we call analytically circular. An account of desire as a species of belief may owe its appeal to the details of its proposal as to precisely what sort of beliefs desires are to be identified with, and its downfall may be due to those details it does provide. For example, it may be proposed that the desire that α is in fact the belief that it ought to be that α, or is morally good or desirable that it should be the case that α. (...) Here the appeal might be that of forging a link between the holding of a moral belief and the acknowledgment that one has a reason for acting a certain way; and the shortcoming of the suggestion is its evident implausibility: even if the ‘necessity’ direction could be established, having a desire hardly seems sufficient for the holding of any such belief. Again: it might be proposed, perhaps simply to bring some order into the realm of propositional attitudes by reducing some to others, that the belief with which we should identify a’s desire that α is a’s belief that he will or would be happy if α. This proposed identification can be seen to be incorrect by consideration of examples such as the following, due to J. Gosling. An aging and ailing parent might forego numerous pleasures in order that his children should reap the benefits of his saving and have a good start in life – perhaps by receiving an expensive education – after his impending death. Oearly he may want that they should so benefit even if he does not believe in an after-death existence in which he might come to know of, and so take pleasure in, his children’s subsequent well-being. Prior once showed that on certain apparently reasonable assumptions, a thesis sometimes associated with the name of Hume to the effect that no set of factual statements can ever entail an evaluative statement, is quite untenable. We assume only that there is at least one statement of each kind, and that the negation of a factual statement is factual — a principle we may call ‘N'. Now consider the disjunction F V E of some factual with some evaluative statement. (...) Since the disjunction is entailed by F, a factual statement, it must, if principle H is correct, be classified as factual.
